Terms and Conditions of the LigaPadla.pl service

1. GENERAL PROVISIONS

  1. The website www.ligapadla.pl operates under the principles set out in these Regulations.
  2. The Regulations define the types and scope of services provided electronically via the website www.ligapadla.pl, the principles of their provision, the conditions for concluding and terminating contracts for the provision of services electronically, as well as the complaint procedure.
  3. Each Service Recipient is obliged to comply with the provisions of these Regulations upon taking steps to use the Electronic Services of the Website www.ligapadla.pl.
  4. In matters not regulated in these Regulations, the following provisions shall apply:
    • Act on the provision of services by electronic means of 18 July 2002 (Journal of Laws No. 144, item 1204, as amended),
    • Act on Consumer Rights of 30 May 2014 (Journal of Laws of 2014, item 827),
    • The Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended) and other relevant provisions of Polish law.

2. DEFINITIONS

  1. CONTACT FORM – a form available on the Website www.ligapadla.pl enabling the Service User to contact the Service Provider directly.
  2. STATUTE – these regulations of the Website.
  3. SERVICE PROVIDER – LigaPadla.pl, registered office address: ul. Postępu 21C, 02-676, entered into the register of entrepreneurs under the KRS number: 0001125893, NIP: 5214084936, REGON: 529610039, with the share capital of PLN 50,000, e-mail address: kontakt@ligapadla.pl.
  4. SERVICE RECIPIENT – a natural person, a legal person or an organizational unit without legal personality, to which the law grants legal capacity, using the Electronic Service.
  5. ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the Website.
  6. NEWSLETTER – Electronic Service allowing the Service User to subscribe and receive free information from the Service Provider to the e-mail address provided by the Service User.

3. TYPE AND SCOPE OF ELECTRONIC SERVICES

  1. The Service Provider enables the use of Electronic Services via the Website, such as:
    • free access to information related to tournaments taking place within the Padel League,
    • paid access to extensive match statistics, rankings and the opportunity to participate in tournaments held within the Padel League,
    • paid participation in selected tournaments organized by the Service Provider.
  2. The provision of Electronic Services to Service Users takes place under the terms and conditions specified in the Regulations.

4. CONDITIONS FOR PROVIDING AND CONCLUDING AGREEMENTS FOR THE PROVISION OF ELECTRONIC SERVICES

  1. The provision of Electronic Services specified in Chapter III, point 1, sub-point 1 of the Regulations by the Service Provider is free of charge.
  2. The provision of Electronic Services specified in Chapter III, point 1, subsection 2 of the Regulations by the Service Provider is subject to payment. The cost of the service is clearly specified on the organizer’s website before payment.
  3. The provision of Electronic Services specified in Chapter III, point 1, subsection 3 of the Regulations by the Service Provider is subject to payment. The cost of the service is clearly specified on the organizer’s website before payment.
  4. The period for which the contract is concluded:
    • the contract for the provision of the Electronic Service consisting in access to information related to tournaments taking place within the Padel League is free of charge and the contract is concluded for an indefinite period,
    • the contract for the provision of Electronic Services consisting in access to extensive match statistics, rankings and the possibility of participating in tournaments is subject to payment, and the contract is concluded for 30 or 365 days, depending on the selected package.
    • the agreement for the provision of Electronic Services consisting in paid participation in selected tournaments organized by the Service Provider is concluded from the moment of payment for the service until the end of the tournament to which the agreement relates.
  5. Technical requirements necessary for cooperation with the IT system used by the Service Provider:
    • computer or telephone with Internet access,
    • access to e-mail,
    • web browser,
    • enabling Cookies and Javascript in your web browser.
  6. The Service Recipient is obliged to use the Website in a manner consistent with the law and good practices, with respect for the personal rights and intellectual property rights of third parties.
  7. The Service Recipient is obliged to enter data consistent with the actual state of affairs.
  8. The Service User is prohibited from providing illegal content.
  9. In the event of a breach of points 6, 7, 8, the Service Provider has the right to temporarily suspend or permanently delete the Service User’s account while retaining all fees paid by the Service User.

5. CONDITIONS FOR TERMINATION OF CONTRACTS FOR THE PROVISION OF ELECTRONIC SERVICES

  1. A Service User who has entered into a distance contract may withdraw from it within 14 calendar days without giving any reason and without incurring any costs. To meet the deadline, it is sufficient to send the declaration before its expiry. A declaration of withdrawal from the contract may be submitted, for example:
    • in writing to the following address: Liga Padla spółka z ograniczoną odpowiedzialnością, ul. Postępu 21C, Warsaw.
    • in electronic form via e-mail to the following address: kontakt@ligapadla.pl.
  2. A sample withdrawal form is included in Annex 2 to the Consumer Rights Act. The Service User may use the form, but it is not obligatory. The withdrawal period begins on the date the license or tournament entry fee is paid.
  3. The Service Provider shall refund the payment using the same payment method used by the Service Recipient, unless the Service Recipient has expressly agreed to a different method of refund that does not involve any costs for him.
  4. A contract for the provision of Electronic Services of a continuous and indefinite nature (e.g. use of the website) may be terminated.
  5. A contract concluded for a fixed period may also be terminated – e.g. access to a paid part of the website or participation in a selected tournament.
  6. The Service User may terminate the contract with immediate effect and without stating the reasons by sending an appropriate statement via email to: kontakt@ligapadla.pl. This may be done at any time.
  7. The Service Provider may terminate a contract for the provision of Electronic Services for a continuous and indefinite period if the Service User violates the Terms and Conditions, in particular by providing illegal content after an ineffective prior notice to cease and desist, specifying an appropriate deadline. In such a case, the contract expires after 7 days from the date of submission of the declaration of intent to terminate it (notice period).
  8. Termination leads to the termination of the legal relationship with effect for the future.
  9. The Service Provider and the Service Recipient may terminate the contract for the provision of Electronic Services at any time by mutual agreement of the parties.

6. PAYMENTS

  1. The following payment methods are available at www.ligapadla.pl:
    • payment via Przelewy24.pl.
  2. The moment of making the payment by the Customer via Przelewy24.pl is considered as the moment of making the payment correctly.
  3. The fees for individual services will be specified each time in the appropriate place on the website www.ligapadla.pl and clearly defined in advance.

7. SUBSCRIPTIONS

  1. The Service Recipient may also use the recurring payment service via the przelewy24.pl website.
  2. Recurring payments provide full access to the service and are renewed once a month.
  3. The Service User has the option to terminate the subscription both via the website www.ligapadla.pl and via e-mail sent to kontakt@ligapadla.pl.
  4. If the Service User cancels the subscription via the website www.ligapadla.pl, it will be canceled automatically and payments will no longer be renewed.
  5. If the Service User cancels the subscription via e-mail, it will be deactivated within 48 hours and payments will no longer be renewed.
  6. The current status of the Service User’s subscription can be found on the website www.ligapadla.pl in the “licence” tab.

8. COMPLAINT PROCEDURE

  1. Complaints related to the provision of Electronic Services by the Service Provider:
    • Complaints related to the provision of paid Electronic Services via the Website may be submitted by the Service User via e-mail to the following address: kontakt@ligapadla.pl.
    • In the above email, please provide as much information and circumstances as possible regarding the subject of the complaint, in particular the type and date of the irregularity, and your contact details. This information will significantly facilitate and expedite the Service Provider’s handling of the complaint.
    • The Service Recipient is entitled to make a complaint regarding the service specified in point III, point 1, sub-point 2 of the Regulations only and exclusively if the Service Provider fails to fulfill its obligations, e.g. fails to provide the Service Recipient with the services specified in the regulations.
    • The Service Recipient is entitled to a complaint regarding the service specified in point III, point 1, sub-point 2 of the Regulations only in a situation where the tournament organized by the Service Provider, to which the Service Recipient registered, did not take place.
    • If the Service User does not take part in the tournament to which he purchased access via the website www.ligapadla.pl, he is not entitled to a refund.
    • The complaint will be considered by the Service Provider immediately, no later than within 14 days.
    • The Service Provider’s response to the complaint is sent to the Service User’s e-mail address provided in the complaint or in another manner specified by the Service User.

9. INTELLECTUAL PROPERTY

  1. All content posted on the website at www.ligapadla.pl is protected by copyright and is the property of www.ligapadla.pl. The Service User is fully liable for any damage caused to the Service Provider resulting from the use of any content on the website www.ligapadla.pl without the Service Provider’s consent.
  2. Any use by anyone, without the express written consent of the Service Provider, of any of the elements constituting the content of the website www.ligapadla.pl constitutes a violation of the copyright of the Service Provider and results in civil and criminal liability.

10. FINAL PROVISIONS

  1. Agreements concluded via the Website are concluded in accordance with Polish law.
  2. In the event of any inconsistency of any part of the Regulations with applicable law, the relevant provisions of Polish law shall apply instead of the challenged provision of the Regulations.
